Apple Adds DMCA Charge to Complaint Against Psystar

The court has granted a motion by Apple seeking to amend its complaint against Mac clone maker, Psystar. According to documents filed with the court, Apple will add a Digital Millennium Copyright Act claim to the original complaint.

Lawyers for Apple said they have discovered additional information since the original complaint was filed. Without going into detail, lawyers said the new information is in regards to Psystar's products and marketing.

This new information supports the amended charge under the Digital Millennium Copyright Act, according to the court documents.

In mid-November Judge William Alsup dismissed a Psystar lawsuit against Apple alleging the Cupertino, Calif. company violated federal and state antitrust laws. In his ruling the judge called Psystar's allegations "internally contradictory."

Apple sued Psystar claiming the company violated its copyrights and licensing agreement when it sold a computer with Mac OS X installed on it. Apple's end-user licensing agreement forbids Mac OS X from being installed on non-Apple hardware.
